CSWL-N104 - Introduction to Trademark Law for Creative Entrepreneurs
Course Description
Building on the knowledge gained in Introduction to IP and IP Strategy for Creative Entrepreneurs, this course, developed in partnership with the Faculty of Law, University of Windsor, Gilbert’s LLP, and eCampus Ontario, explores trademark law. Students learn how to align their trademark strategy with branding strategy and how to protect trademarks in Canada. Topics include trademark basics and history, acquiring trademarks, commercializing trademarks and selling a brand, protecting trademarks including domain name disputes, and special topics and emerging trends in trademark law such as Artificial Intelligence (AI). The course empowers creative professionals with an understanding of their legal rights, so they may advocate for themselves and engage in informed discussions with legal professionals.
LEARNING OUTCOMES
Upon successful completion of this course, students will learn:
- The basic legal principles, history, and policy rationale for trademarks,
- The administrative process for obtaining a registered trademark, including trademark searches, selection and classification of goods and services, and the Canadian trademark prosecution process,
- To recognize the inherent value of trademarks, and the ability to generate goodwill, reputation and business by implementing a sound trademark strategy,
- The best practices to protect trademarks,
- The differences between registered and unregistered trademarks, as well as the different forms of trademarks.
